‘Migrant’ Charged With Raping Girl Under 13 Who Birthed Child in Louisiana
An immigration detainer has been filed against a man charged with raping a girl under 13 who gave birth to a child that may be his in Louisiana, according to reports.
On Saturday, the Calcasieu Parish Sheriff’s Office (CPSO) announced the arrest of 39-year-old Jose Lopez Montoya.
CPSO says they were alerted about a girl under the age of 13 who had just given birth at a local hospital.
“During the initial investigation, detectives spoke with the victim who stated Jose L. Montoya, 39, Lake Charles, had sexual intercourse with her numerous times over the past two years,” CPSO explained in a press release.
“When detectives spoke with Montoya he confirmed the allegations. He also advised detectives the newborn is likely his child.”
Authorities learned Montoya was the victim’s guardian, but details about their relationship remain unclear.
“This was a very unfortunate situation,” Sheriff Stitch Guillory stated in a press conference. “He was responsible for her well-being, and her mom and dad are not around. So, this is a really disappointing situation. He’s a pretty sick individual.”
“It’s hard to believe that this little girl, who’s under the age of 13, went nine months term pregnancy and nobody noticed and nobody said anything.”
Montoya was charged with two count of first-degree rape and booked into Calcasieu Parish Correctional Center on $1.5 million bond, KPLC reports.
Immigration and Customs Enforcement has issued a detainer against Montoya, indicating he may be in the U.S. illegally.
An investigation is ongoing.
