Suspected Illegal Alien Charged With Raping 10-Year-Old Girl in Arkansas

A suspected illegal alien has pleaded guilty to sexually assaulting a preteen victim in Arkansas.

On August 17, 2022, authorities visited a home in the city of Paragould after someone called the Arkansas child abuse hotline to report sexual abuse of a minor, a probable cause statement indicates.

A 12-year-old girl identified an adult male whom she said had been performing sexual acts upon her at the residence since she was 10.

An adult female told investigators she had been alerted about the abuse approximately two months prior and claimed to have ensured the victim and suspect were never alone together after receiving that information.

Jose Juan Rodriguez-Cruz, who was 41 at the time, was arrested and charged with rape and second-degree sexual assault.

In June of 2024, Rodriguez-Cruz’s attorney filed a motion to exclude evidence in his client’s trial, including details about the accused’s immigration status.

“Defendant believes that the State will offer evidence to show that the defendant is an illegal alien,” the motion stated.

“Defendant is charged with Rape and Sexual Assault in the second degree and any evidence that tends to show that the defendant may or may not be an illegal alien does not make the existence of any fact of consequence more or less probable and is thus irrelevant.”

On July 15, Rodriguez-Cruz pleaded guilty to Sexual Assault 2nd Degree in the Circuit Court of Green County, AK.

Rodriguez-Cruz was sentenced to 240 months in prison with credit for 46 days served.

His immigration status and country of origin are still unclear.
